The web site bookconfirm.com and all partner sub-sites are owned and operated by Bookconfirm 37 Venner Road Annerley, Qld Australia ( 'We', 'Our' or 'Us'). Any reference to YOU includes any employees, agents or persons accessing and using this website to purchase or book any product. Any use of the word 'tour' incorporates anything we or Operators take bookings for on our or their websites including, bu not limited to: Sightseeing tours, rockclimbing and scuba diving courses/packages, bus trips, boat trips and spa or beuty packages.

We operate this service on behalf of Tour and Accommodation providers, as well as Tourism Associations ('Operator'). We are not a travel agent, nor do we consult on accommodation or travel. We provide booking and reservation software that allow Tour and Accommodation Operators to sell their products via various online formats. All content and information on this website is created and managed by the individual Operators. As such we do not require a travel agent's licence. We provide this service at an agreed processing fee.

All terms and conditions displayed here are to be read together with any other policies and conditions displayed elsewhere in this (and the Operator's) web site. This includes any terms and conditions that may be printed on the confirmation email or displayed anytime during the tour booking process. All claims whatsoever are the sole responsibility of the relevant Travel Operator and to the extent permitted by the law. We have no liability to you.

When You make a purchase on this web site You agree to be bound by the Terms and Conditions comprising the Conditions of Use, Conditions of Sale, Refund, No-Show and Cancellation Policy, Security and Fraud Policy and Privacy policy as described herein and displayed elsewhere on this website.

Your privacy is respected and we are obligated to protect your privacy by law. We use the latest up to date security technology to ensure the protection of your details.

We may alter or change the terms and conditions from time to time and by using this service you agree to be bound by any such alterations or changes and use of this site is restricted to personal use and reference only.

The images, text, logos and artwork contained within this site are copyright to Us and/or the licensee owners and used by permission all rights reserved. Unauthorised use by way of copying, storage, reproduction, publishing electronically or otherwise, transmitting in any form or by any means in whole or in part is prohibited.

We will not be liable for any damages direct, incidental, consequential or otherwise, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from Your access to, or use of, or inability to use the web site and its content, whether based in contract, tort, negligence, statute or any other legal theory, and whether or not We know of the possibility of such damage to the extent permitted by law.

We limit Our maximum liability to You whether for breach of these terms or in negligence or in any other tort or for any other common law or statutory cause of action arising in relation to these terms, the site or the content available through the site is limited to $100 Australian dollars to the extent permitted by law.

This agreement shall be governed by the laws of the State of Queensland, Australia.

Conditions Of Sale

All Prices can be displayed in your preferred currency, however, although all care is taken to procide up to date exchange rates the prices displayed in any currency other than Australian Dollars are approximate. We only transact in Australian dollars (AUD) and take no responsibility for currency fluctuations.

Online sales will cease when the number of available products for a specific date have been sold or at a time otherwise specified by the Operator.

Purchases are not transferable without written consent from the Operator that the product is booked with.

The Operator reserves the right to alter the date, the itinerary and duration of the booked product and/or activities as advertised without prior notice. However, if an Operator cancels or changes the date for a tour/ /accommodation for which You have booked and providing You have not given consent or agreed to this change You will be able to apply for a full refund of any payment already made for that tour/accommodation. There may be an administration charge for this refund. Any such application should be made directly with the Operator. We will assist in case a resolution with the Operator cannot be reached.

It is illegal to re-sell your purchase for profit or gain and any person or company caught attempting to do so shall be prosecuted to the full extent of the law.

We and the Operator reserve the right not to sell tour/accommodation products to any person, agent or company.

Any details provided will be checked for their validity to prevent fraud. Credit card fraud increases the cost of tour/accommodation products. If We suspect fraud We reserve the right to request certain proof of identity documents prior to confirming a booking. If You attempt to make fraudulent transactions on our site(s) we will prosecute to the full extent of the law.

The operator may have their own conditions and We recommend You view these prior to purchase. They are usually available on the operators' web sites or elsewhere on this web site. If you are unsure about an operator's conditions of sale please contact the operator or bookconfirm prior to booking using the 'contact us' link on this or the operator's website.

Some tours may require a certain level of fitness. If you have any doubts about your ability to participate in these activities please contact the Operator prior to booking using the 'contact us' link at the top of this or the operator's website.

We strongly recommend you take out travel insurance prior to your booking. This MAY compensate you for any illness, injury, loss/damage prior to booking and or partaking in any products sold via this website. These policies MAY cover both personal injuries and not being able to travel on confirmed departure dates.

Refund, No-Show & Cancellation Policy
  1. Rescheduled Tour/Accommodation date: The Operator reserves the right to alter the, date, time of tour and/or duration. If the tour or booked accommodation date is rescheduled then Your purchase of the advertised product will remain valid. If You cannot attend on the rescheduled date We will refund to Your purchase. There may be an administration charge for this refund. This will be done in a timely manner, provided that the original tour/accommodation proof of purchase is presented. Please email the Operator directly to request a refund.
  2. Cancellation: If the tour/accommodation dates are cancelled because of an act of war or terrorism or the forces of nature or by any event outside of the control of the Operator then refunds shall be at the Operators absolute discretion. If the booking is cancelled for any other reason, We will refund to you, provided that the original tour/accommodation proof of purchase is presented. There may be an administration charge for this refund. Please email the Operator directly to request a refund. Bookconfirm transacts in Australian Dollars (AUD) only and accepts no responsibility for currency fluctuations.
  3. No Show: (failure to appear for tour/accommodation booking). We fulfil Our commitment to You for the sale of tour/accommodation products by emailing the ticket/receipt to You. Please email the Operator directly to request a refund.
  4. Refunds, Exchanges, transfers: Any refunds requested by YOU will incur a fee of 5% of the total tour price. **There may also be additional charges added by the Tour Operator**. These fees are usually found on the Operators website or in the confirmation email we send you upon your booking. Please email the Operator directly to request further information regarding their refund policy or to request a refund. We will not be responsible for contacting the Operator on your behalf. Bookconfirm transacts in Australian Dollars (AUD) only and accepts no responsibility for currency fluctuations.
  5. Deposit Only bookings: Any deposits paid for tours or accommodation are non-refundable under any circumstances. If the amount you have paid in advance for your booking is less than the amount payable as stated in point 4 (above) you will be charged the additional amount using the same method you used to make the first payment. If we cannot recover this additional amount we will attempt to contact you. Should you fail to pay the outstanding amount we may pass the information onto a third party or the Operator to recover any outstanding balance.
  6. Responsible Party: For Inquiries or Complaints Regarding the sale and delivery of tour/accommodation please contact us. Regarding the staff and/ or amenity during the tour/accommodation stay please contact the operator or accommodation management directly. Regarding the operators performance, accommodation or general complaints, please contact the Operator.
  7. Dispute resolution: If You have an issue with Our service or feel You have been unfairly treated please contact us. If You have already contacted Us and feel that You have not been fairly and reasonably treated, please email Us and ask Us for Our Dispute Resolution Procedure document. This document clearly outlines Your rights and avenues of appeal.

When We process Your order We collect Your credit card and personal information in keeping with Our Terms and Conditions of Use Our Refund Policy, Our Conditions Of Sale and Our Privacy Policy.

When processing Your payment We use a 256-bit SSL (Secure Socket Layer) system to encrypt all orders.

At no stage does Your credit card number get collected or stored in Our system. The only party to receive the entire card number is Our bank and Secure Payment Gateway.

Fraud Policy

This policy is designed to protect the interests and security of Our customers.

When Ordering: We record Your host name, IP address and the time and date of the purchase to assure complete safety and security in completing any order via Our network. We can then use this IP address to obtain proof of access via the port and modem that logged on to Our network. Even AOL and Hotmail and other dynamic IP addresses gives Us the information needed to prosecute. This information is only collected for fraud prevention and will not be sold / given to any 3rd party. Please see Our Privacy Policy for more information. We will also use secure server technology to ensure Your details are protected. When processing Your payment We use a 256-bit SSL (Secure Socket Layer) system to encrypt all orders. Please see Our Security Policy for more information. We will email You upon receipt of Your order, verifying Your email address. Our on-line processing gateway automatically checks the database of Your credit card provider for reported lost or stolen card numbers and to verify against information from credit card providers that informs Us of lost, stolen and ¿continual chargeback¿ credit card numbers. We may also call You on the telephone to verify who You are as Our fraud policy provides for a random number of customers to be called each day by Our staff.

When Delivering: We will deliver Your purchase to You by the option You have selected at time of purchase. In any case, all options provide for You the customer to show identification and/or sign for the delivery of the goods. Please see Delivery Options during purchase for more information.

When You deny or dispute a charge: If You dispute Your charge contact Us now. Any person(s) committing fraud on Our network will be dealt with to the highest penalty allowable under law, without exception. If You falsely dispute a charge or falsely deny a payment on Your credit card will We start legal proceedings against You to recover the amount disputed, plus any costs incurred in collecting the proof or data required to ensure prosecution including international travel, hotel, car hire, fuel, meals etc and or any fees or costs relating to Our designated agent to appear in court. Credit card fraud is a serious offense and will be prosecuted to the fullest extent possible. This no tolerance policy of fighting back each and every case of credit card fraud by the designated agent will cost You much more money than the original amount of the service(s) You received.
